The Firm’s client – an American pharmaceutical company – faced a claim filed by a Russian distributor. The controversy between our client and the claimant concerned a violation by the local company of the terms of payment of a bonus under a supply contract to the latter. The BGP Litigation lawyers successfully drew the court’s attention to the relevance of Art. 19.28 of the Russian Administrative Offences Code in hearing the issue of bonus payments to the distributor, as well as had the doctrine of consistent conduct applied in practice.
The combined expertise of the Dispute Resolution & Bankruptcy team and the Life Sciences & Technologies team allowed us to render comprehensive assistance to the client and secure a successful outcome. The court of first instance dismissed the distributor’s claim against our client. The court’s judgment may prove decisive in the practice on the issues of applicability of discounts and bonuses in the pharmaceutical sphere.
