BGP Litigation Lawyers Help Netmonet Service Procure Inclusion of Their Software into Russian Software Register

BGP Litigation lawyers have helped a Russian IT company (the "Company") that has developed Netmonet, an online tipping service, procure inclusion of their original software into the Unified Register of Russian Programs for Electronic Computers and Databases (the "Register").  Now, the client can realise the benefits offered to software products included into the Register, e.g. enjoy tax privileges.

As part of the project, our team audited the Company's internal documentation and helped collect the documents certifying the Company's exclusive rights to the software product.  There have been prepared key documents in conformity with the requirements of Russia's Ministry for Digital Technology, Communication and Mass Media ("Russia's Digital Ministry"): description of the software product's performance specifications and key functions, a trial version of the software for the expert, software manual, ownership structure of the software owner company.

Applications for registration in the Register filed by companies are frequently dismissed on formal grounds, noted Anastasia Dudko, Advocate and Senior Associate with BGP Litigation and Project Team Leader.  Dismissals are linked to numerous changes in the list of documents and details required to be provided together with the application.  "I am aware of the instances where Russia's Digital Ministry dismissed a registration application having referred to amendments that were adopted after the application filing date," Anastasia said.  "To minimise such risks, you should monitor amendments on an ongoing basis, including as of the date of filing of the application."
