A comprehensive case related to recovering of a large amount of debt from a famous Russian shoe retailer within the bankruptcy procedure.
Situation:
A group of complicated matters with participation of foreign entities unfairly delaying a trial using particularities of the Russian legislation; subject of the pledge is goods held for sale. We managed to document the fact of the pledger having the goods held for sale by engaging bailiffs and surveyors, in spite of the fact that the opponents actively tried to avoid providing access to the subject of the pledge for review.
Result:
The debt was fully collected from the debtor and the guarantor who was a Russian natural entity. The Client's claims were included ininto the register of the creditors of the Russian guarantors of the debtor.
Access to the warehouse to which the pledged property was moved without the Client’s consent was ensured by the court order, the preservation of the subject of the claim was ensured.
As a result of the abovementioned actions, the Client’s claims were included into the register of the creditors of the pledger and the pledge secured for the full amount of claims.
